Interpretation of the newly revised Safety Production Law

In order to enhance the legal and safety awareness of company employees, on November 14, 2024, a systematic study of the "Work Safety Law of the People's Republic of China" (Third Revision), consisting of seven chapters and 119 articles, will be organized for all employees in the conference room on the fourth floor of the company; All employees of the company fully recognize the importance and necessity of safety production.    

The new "Work Safety Law of the People's Republic of China" proposes for the first time the concept of "people-oriented and safe development"; Safety is an unbreakable red line, which is to adhere to the principle that 'development must not be at the expense of human life and health'; We must firmly establish the concept of "people-oriented, life first"; Correctly handling the issue of "ensuring production" or "ensuring safety" in emergency response to major risks and accidents; Require that 'safety must be managed in production and operation, safety must be managed in industries, and safety must be managed in business' and' production must be safe, and safety can only be produced '. The new safety law has strengthened this concept from two aspects: firstly, it clarifies the responsibilities of various aspects and personnel of safety production management work (including the responsibilities of production and operation units, main responsible persons, safety management institutions, and safety management personnel); Secondly, clarify the scope of safety responsibilities and implement them to every employee; To achieve the goal of "full staff, comprehensive, full process, and round the clock" safety production work.

Through studying the new "Work Safety Law of the People's Republic of China", it is known that the main key points of the new law are "clarifying responsibilities, implementing responsibilities, and pursuing responsibilities"; The new safety law responsibility system is: ① "Strengthen and implement the main responsibility of production and operation units and the government's regulatory responsibility"; ② Establish a mechanism for production and operation units to be responsible, with full participation of all staff, government supervision, industry self-discipline, and social supervision; ③ The main person in charge of the production and operation unit is the first person responsible for safety production, and is fully responsible for safety production work. Other responsible persons are fully responsible for safety production work within their scope of responsibilities.

The comprehensive implementation of the main responsibility of production and operation units is to adhere to the safety production policy of "safety first, prevention oriented, and comprehensive management"; Clarify the main position, main tasks, and fundamental ways to achieve safety production.

Safety first "refers to the principle of always prioritizing safety, especially the personal safety of employees and other personnel, in the relationship between ensuring safety and achieving other goals of production and operation activities, and implementing the principle of" safety first ". Adhere to the principle of putting people first, while ensuring safety, achieve other production and operation goals, and promote smooth production and operation activities while ensuring safety in production. 'Safety' is a prerequisite for production, 'no production without safety'. The statement 'production must be safe, safety is for production' is consistent with the phrase 'safety first'.

Prevention first "refers to placing the prevention of production safety accidents as the top priority in safety production work, striving to prevent them beforehand rather than remedying them afterwards; In production and daily activities, accidents should be eliminated at the embryonic stage. As long as we attach importance to them ideologically and take appropriate preventive measures, accidents can be prevented and reduced; This includes two aspects: eliminating accident hazards and emergency rescue hazards. To achieve the above requirements, "comprehensive governance" is needed.

Comprehensive governance "means" treating both the symptoms and root causes, with a focus on addressing the root cause ". The Fifth Plenary Session of the 16th Central Committee of the Communist Party of China for the first time enriched "comprehensive governance" into the safety production policy, and in 2014, the "Safety Production Law" was revised and incorporated into the law. While taking effective measures to curb accidents and address the symptoms, we actively explore and implement fundamental solutions. We comprehensively utilize "technological, legal, economic, and necessary administrative means" and start from aspects such as "development planning, industry management, safety investment, technological progress, economic policies, education and training, safety legislation, incentives and constraints, enterprise management, regulatory system, social supervision, and accountability for accidents, as well as investigating and punishing illegal and disciplinary violations". We aim to achieve a sound ideological understanding, rigorous and effective institutional safeguards, strong and effective technical support, rigorous and meticulous supervision and inspection, and serious and conscientious accident handling. Comprehensive governance "includes the management and supervision of enterprises by relevant government forces and social stakeholders; Manage and supervise the safety of various functions and levels within the enterprise, and systematically govern the three production elements of "people, machines, and environment" from a safety technology perspective; The main responsibility of enterprises is reflected in the implementation of "systems, norms, measures, implementation, procedures, inspections, and responsibilities"; Establish and implement a dual prevention mechanism for safety risk classification control and hidden danger investigation and management; Comprehensively control various "hazards" to ensure the production safety of the company.
